2. Service Description

HowIsMyLand is a platform that connects property owners with verified local agents for property inspection services. Our services include:

  • Standard property inspections with photographic documentation
  • Video walkthrough services
  • Property verification and status reporting
  • Agent-owner communication facilitation

3. Property Owner Responsibilities

As a property owner using HowIsMyLand, you agree to:

  • Provide accurate and complete information about your properties
  • Ensure you have legal ownership or authorization to list properties
  • Maintain the confidentiality of your account credentials
  • Pay all applicable fees for inspection services in a timely manner
  • Review and respond to inspection reports within a reasonable timeframe
  • Treat agents with respect and professionalism

4. Payment Terms

4.1 Service Fees: Property owners agree to pay the fees displayed at the time of requesting an inspection service. Current pricing:

  • Standard Inspection: ₹25 per visit
  • Video Walkthrough: ₹40 per visit

4.2 Payment Processing: All payments are processed securely through our payment gateway. Payment is required before an inspection request is submitted to agents.

4.3 Fund Release: Funds are held in escrow and released to the agent only after you approve the inspection report. By approving a report, you authorize the release of payment to the agent.

4.4 Refunds: Refunds may be issued at our discretion if an agent fails to complete the inspection or if there are significant service quality issues. Refund requests must be submitted within 7 days of the inspection date.

5. Inspection Services

5.1 Service Delivery: Agents will make reasonable efforts to complete inspections within the agreed timeframe. However, HowIsMyLand does not guarantee specific completion times.

5.2 Report Quality: While we verify our agents, the quality and detail of inspection reports may vary. Reports are provided "as-is" and represent the agent's observations at the time of visit.

5.3 Property Access: You are responsible for ensuring agents can access the property for inspection. If access is denied or unavailable, you may still be charged for the service.

6. Limitation of Liability

6.1 Service Limitations: HowIsMyLand acts as a platform connecting owners and agents. We are not responsible for:

  • The accuracy or completeness of inspection reports
  • Any damages to property during inspections
  • Disputes between owners and agents
  • Any decisions made based on inspection reports
  • Loss of property value or rental income

6.2 Maximum Liability: Our total liability to you for any claims arising from the Service shall not exceed the amount you paid for the specific inspection service in question.

7. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy. By using the Service, you consent to:

  • Collection of property location data and details
  • Sharing necessary information with assigned agents
  • Storage of inspection reports and photographs
  • Communication via email and in-app notifications

8. Intellectual Property

8.1 Platform Content: All content on HowIsMyLand, including logos, design, text, and software, is owned by HowIsMyLand and protected by intellectual property laws.

8.2 Inspection Reports: You retain ownership of information about your properties. Inspection reports and photographs become your property upon payment approval, but we retain the right to use anonymized data for service improvement.

9. Account Termination

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms and Conditions
  • Provide false or misleading information
  • Engage in fraudulent payment activities
  • Harass or abuse agents or staff
  • Use the Service for illegal purposes

10. Dispute Resolution

10.1 Informal Resolution: We encourage you to contact us first to resolve any disputes informally.

10.2 Governing Law: These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in [Your City], India.
